Effective Date: September 8, 2026

These Terms of Service (the "Terms") govern your access to and use of the products, services, website, and related offerings provided by Maple & Stone Furnishings Ltd. ("Maple & Stone Furnishings Ltd.", "we", "us", or "our"). By visiting our website, requesting a quote, placing an order, making a purchase, booking a consultation, accepting delivery, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

1. Introduction and Acceptance of Terms

These Terms form a legal agreement between you and Maple & Stone Furnishings Ltd. and apply to all visitors, customers, clients, and other users of our services. You represent that you have the legal capacity to enter into this agreement and, where applicable, authority to bind any business or organization on whose behalf you act.

For purposes of Canadian law, these Terms are intended to be read in a manner consistent with applicable federal and provincial laws, including consumer protection, privacy, electronic commerce, and sale of goods laws in British Columbia and Canada.

2. Scope of Services

Maple & Stone Furnishings Ltd. provides furniture-related products and services, which may include, without limitation:

We reserve the right to modify, suspend, or discontinue any part of our services at any time, subject to applicable law and any binding written agreement.

Any drawings, renderings, samples, finishes, dimensions, estimates, timelines, product images, or recommendations provided by us are for informational purposes and may be subject to change based on material availability, manufacturing tolerances, site conditions, or customer-approved specifications.

3. User Obligations and Responsibilities

You agree to provide accurate, current, and complete information when interacting with us, including contact details, delivery information, measurement information, access instructions, and any other information reasonably required to fulfill your Order.

If you provide content, specifications, images, measurements, or instructions, you warrant that you have the necessary rights to provide them and that they do not infringe any third-party rights.

4. Payment Terms and Conditions

All prices are stated in Canadian dollars unless otherwise indicated. Prices may be subject to applicable taxes, shipping charges, installation fees, handling charges, custom fabrication costs, restocking fees, or other charges disclosed at the time of quotation or invoicing.

Unless otherwise agreed in writing:

For custom fabrication, commercial projects, restoration work, and bulk orders, quoted prices may change if the scope changes, materials are substituted at your request, site conditions differ from the information provided, or additional labour is required due to customer-requested revisions or unforeseen issues.

You authorize us to charge any agreed payment method for amounts due, including deposits, balance payments, delivery charges, storage fees, and approved change orders. If a payment is reversed, declined, or charged back without valid reason, you may be liable for administrative costs, bank fees, and collection expenses to the extent permitted by law.

5. Cancellation and Refund Policy

Because many of our products and services are custom-made, made-to-order, or otherwise tailored to your specifications, cancellations and refunds are limited as set out below and subject to applicable consumer protection law.

If you request cancellation before production or service commencement, we may, at our discretion, offer a refund less any non-recoverable costs, design fees, administrative fees, material costs, supplier charges, or processing fees, to the extent permitted by law.

Any defects, shortages, or shipping damage must be reported to us promptly upon receipt or within a reasonable time after discovery. We may require photographs, inspection, and reasonable documentation to assess the issue. Remedies, if any, may include repair, replacement, re-delivery, or a refund, at our discretion and as required by law.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple & Stone Furnishings Ltd. shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profit, loss of revenue, loss of business opportunity, loss of goodwill, or loss of data arising from or related to the use of our services, products, or website.

Without limiting the foregoing, we are not responsible for:

Where liability cannot be excluded under applicable law, our total aggregate liability for any claim arising out of or relating to the services or products shall be limited to the amount actually paid by you to Maple & Stone Furnishings Ltd. for the specific product or service giving rise to the claim, except where a different limit is required by law.

Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable law, including liability for gross negligence, willful misconduct, or statutory rights that cannot lawfully be waived.

7. Intellectual Property Rights

All intellectual property rights in our website, branding, product designs, photographs, drawings, specifications, renderings, plans, text, graphics, logos, and other materials created or provided by Maple & Stone Furnishings Ltd. remain our exclusive property or the property of our licensors, unless otherwise agreed in writing.

You may not reproduce, copy, modify, distribute, publicly display, reverse engineer, or create derivative works from our materials without our prior written consent, except as permitted by law.

Where we create custom designs, concept drawings, shop drawings, plans, or specifications for you, unless otherwise agreed in writing, we retain all intellectual property rights in the underlying methods, templates, and pre-existing materials, and you receive only a limited, non-exclusive right to use the deliverables for the intended project and location for which they were provided.

You grant us a non-exclusive, royalty-free right to use any feedback, testimonials, or project images you voluntarily provide for marketing, portfolio, operational, or quality-improvement purposes, subject to applicable law and any confidentiality or privacy obligations.

8. Data Protection and Privacy

We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable British Columbia privacy requirements.

Personal information may be used for purposes including:

We may share personal information with service providers, contractors, payment processors, delivery partners, and other third parties necessary to perform the services or comply with law, subject to appropriate safeguards.

By using our services, you consent to the collection, use, and disclosure of your personal information as described in our privacy practices and as reasonably necessary to provide the services. You may contact us to request access to or correction of your personal information, subject to lawful exceptions.

If a force majeure event occurs, we may suspend performance for the duration of the event and may reasonably extend timelines, re-schedule services, or cancel affected orders if performance becomes impracticable or commercially unreasonable.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our operations, legal requirements, or business practices. The updated Terms will be effective when posted on our website or otherwise communicated to you, unless a later effective date is stated.

Your continued use of our services after any change constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services and, where applicable, notify us regarding any active order or service engagement.

11. Applicable Law and Jurisdiction

These Terms and any dispute, claim, or controversy arising out of or relating to them, the services, or any Order shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that the courts located in British Columbia, Canada shall have exclusive jurisdiction over any dispute arising from or related to these Terms, except where applicable law requires otherwise or permits a consumer to bring a claim in another forum.
